Terms of Service

The terms that govern your use of QuickMailer, including accounts, Gmail sending, acceptable use, and limitations of liability.

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of QuickMailer ("QuickMailer", "we", "us", or "our"), including our website, dashboard, and related services.

By signing in or using QuickMailer, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. The service

QuickMailer lets you create reusable email templates, manage contacts, and send personalized emails through your connected Gmail account. Features may change over time as we improve the product.

QuickMailer is not affiliated with Google LLC. Gmail and Google are trademarks of Google LLC.

3. Accounts

  • You must sign in with a valid Google account you are authorized to use.
  • You are responsible for activity under your account and for keeping access to your Google account secure.
  • You must provide accurate information and promptly update it if it changes.
  • We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Gmail connection and sending

To send email, you must authorize QuickMailer via Google OAuth. You control this permission and may revoke it at any time in QuickMailer or in your Google Account settings.

Emails are sent from your Gmail address using Google’s APIs. You are solely responsible for the content of messages you send, recipients you choose, and compliance with applicable email, spam, and marketing laws (including CAN-SPAM, GDPR, and similar rules).

Google may limit or revoke API access. Delivery rates, spam placement, and Gmail quotas are controlled by Google and your mailbox reputation — not guaranteed by QuickMailer.

5. Acceptable use

You agree not to use QuickMailer to:

  • Send spam, phishing, malware, or deceptive messages.
  • Harass, defraud, or harm others, or violate any law or third-party rights.
  • Attempt to access other users’ data, probe our systems, or disrupt the service.
  • Reverse engineer, scrape, or misuse the product beyond normal use.
  • Resell or sublicense the service without our written permission.

6. Your content

You retain ownership of templates, contacts, and other content you upload or create. You grant us a limited license to host, process, and display that content solely to operate QuickMailer for you.

You represent that you have the rights needed to use and send the content you provide, including any images, attachments, and personal data of recipients.

7. Plans, billing, and free use

Some features may be free; others may require a paid plan. Pricing and limits may change with notice. Fees, if any, are non-refundable except where required by law or stated otherwise at purchase.

If payment fails or a subscription lapses, we may limit access to paid features.

8. Intellectual property

QuickMailer, including its branding, interface, and software, is owned by us or our licensors. These Terms do not grant you ownership of our intellectual property. You may not copy or misuse our marks without permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or that emails will always be delivered or opened.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKMAILER AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless QuickMailer and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, your emails, or your violation of these Terms or applicable law.

12. Termination

You may stop using QuickMailer at any time and may request account deletion. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

13. Changes to the terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a new “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws applicable in the jurisdiction where the service operator is established, without regard to conflict-of-law principles. Courts in that jurisdiction will have exclusive venue for disputes, except where prohibited by law.
